Can I still be fired for testing positive for cannabis on a drug test in Oklahoma?

In Oklahoma, having a valid medical marijuana card does give you some employment protections, but it doesn’t make you completely immune from being fired. Under House Bill 2612, employers cannot fire you just because you are a licensed medical marijuana patient. However, there are important exceptions:

  • Safety-sensitive jobs: If your role involves tasks that could affect your safety or the safety of others (like operating heavy machinery, driving, handling hazardous materials, or direct patient care), employers can enforce stricter rules. Testing positive for cannabis in these positions can still lead to termination.

  • Federal law conflicts: Employers who must comply with federal regulations or funding requirements (for example, transportation or defense contractors) may still prohibit cannabis use entirely.

  • On-the-job use: Even if you’re a patient, you cannot consume or be under the influence of cannabis while at work. Employers can discipline or terminate employees who violate workplace drug policies.

So, while your patient status protects you from being fired solely for holding a medical marijuana license, a positive drug test can still put your job at risk depending on your role and employer policies.
