No. West Virginia's medical marijuana law specifically states that "employers may not discharge, threaten, refuse to hire, or otherwise discriminate or retaliate against an employee solely based on that employee’s status as a registered medical cannabis cardholder." However, employers aren't required to violate federal law in their efforts to adhere to state law, so certain employers that are constrained by drug-free workplace laws will still fire or refuse to hire a person who shows a positive drug test for cannabis.
